In built-up areas, horns are not allowed outside of any emergency situation. This rule is recalled by the Court of Cassation in a judgment of 4 June 2019.
One driver was subject to a report for misusing his horn in built-up areas and in broad daylight. He was, however, acquitted by the police court, which held that the use of the horn, which was probably untimely but limited, had not caused any disturbance of public order or public tranquility.
The Court of Cassation strictly applied the texts and did not retain the one made by the police court. The absence of an immediate danger alone justifies the prohibition of the use of horns in built-up areas and is liable to a fine.
