Employee resignation: what unemployment rights?

These decrees set out, among other things, how to apply and coordinate the new right to compensation that the law on the freedom to choose one's professional future, passed in September 2018, allows resignations.

Linked to a training or company creation/takeover project, this new right guarantees the employee a replacement income during the conversion period which lasts on average 15 months. It will be strictly regulated:

• the employee must have at least 5 years of activity in a company;
• before resigning, he must ask for a professional development consultant (CEP) from an authorized operator and then send a request to a joint committee (trade unions/employers) in his region for certification of the real and serious nature of his project;
• this committee will examine in particular the relevance of the training identified and the job prospects or, for a company, the financing needs and the technical and human resources envisaged;
• once the certificate is obtained, the employee will have 6 months to submit an application for an allowance to Pôle emploi who will be responsible for monitoring the actual implementation of the project.

The level of compensation will be the same as for other job seekers.

This right will be renewed every 5 years, i.e. 8 times over a working life of 40 years.
