Seeds, which are not included in the Official Catalog because of their instability or heterogeneity (e.g. old varieties), can now be sold to amateur gardeners or exchanged. The Act on Transparency of Information on Agricultural and Food Products was published in Official Journal 11 june 2020. It amends the Rural and Maritime Fisheries Code.
Until then, only seeds of a variety listed in the Official Catalog of Cultivated Plant Species and Varieties could be marketed.
Such exchanges or sales of seed of varieties in the public domain shall be limited to non-professional users who will not commercially exploit the variety.
The placing on the market of seed shall entail compliance with:
health and quality rules, germination rate, packaging and labeling...
and the common law provisions of the Consumer Code (personal safety and health, fair trading and consumer protection).
