From 1er November 2020, bank charges will be capped from 5 irregularities or incidents in the same month. Fragile customers will benefit from the €25 per month for a fixed period of 3 months. A decree issued in Official Journal july 22, 2020, clarifies what a fragile customer is and controls fees related to payment incidents.
A customer will be considered fragile in the following cases:
if it accumulates 5 payment irregularities or incidents in the same month and no longer only as a result of account irregularities or repeated payment incidents for three consecutive months:
whether its over-indebtedness file is being processed and no longer only if it is in over-indebtedness;
if it is entered for 3 consecutive months in the Bank of France's file centralizing check payment incidents.
A fragile customer will have their bank charges capped at €25 (or €20 if it has a specific offer

of its bank) for 3 months instead of a shorter and variable duration depending on the banking institutions.
Please note
In assessing whether a customer is fragile, the banking institution shall also take into account the amount of resources credited to his account or any factor known to him which might give rise to payment incidents, such as in particular expenses debited to the account.
