Pursuant to certain provisions laid down by the Law of 10 February 2020 on the fight against waste and the circular economy, a decree published in Official Journal on 1er january 2021 specifies the conditions for prohibiting the making available of certain single-use plastic products.
As of 1er in january 2021, the sale and making available of certain plastic products is progressively prohibited after disposal of stocks ordered before 2021 and at the latest by 1er July 2021. These are:
- all cutlery, except those used in prisons, health facilities and in air, rail and sea transport and non-food dosing utensils, which shall be allowed until 3 July 2021;
- cardboard disposable plates with plastic film and compostable plastic plates;
- expanded polystyrene boxes for take-out or take-out food at the point of sale;
- cups, whether or not compostable, in particular those of expanded polystyrene;
- beverage lids and caps;
- straws, with the exception of those intended for medical purposes;
- soft drinks' toilets;
- bottles made available free of charge in places open to the public and in professional settings, or distributed during festive, sporting or cultural events;
- steak barbs;
- confetti and sequins;
- balloon shafts;
- all oxo-degradable plastic articles (plastic containing additives which lead to fragmentation of the plastic into micro-fragments or to chemical decomposition under the effect of oxidation).

Products designed, created and placed on the market to carry out, during their lifetime, several journeys or rotations by being returned to a producer to be refilled are not covered by this prohibition.
