A new family booklet adapted to recent family law reforms

The new model of family booklet takes into account medically assisted reproduction (MAP), the new name choice rule, adoption reform, the identity of children born lifeless and the death certificate of adult children. City councils, however, will be able to sell off their old models.

The new model of family record book, set by the decree of 3 May 2022, is amended in both parts: extracts from civil status documents and information relating to civil status and family law. These amendments take into account the new provisions on medically assisted reproduction (MAP), the new name choice rule, adoption reform, the identity of children born without life and the death certificate of adult children.

As regards female couples who use the PMA, according to the Order of 3 May 2022,

filiation is established, in respect of the woman giving birth, by her only designation in the child's birth certificate. In respect of the other woman, filiation is established by the anticipated joint recognition made before the notary in conjunction with the consent given to the assisted reproduction.

This new booklet also adapts to the recent renaming regulations, simplified when the choice relates to a name derived from filiation.

Similarly, it also retains new provisions of the adoption, especially for couples who have been living together for more than a year, and for those who are more than 26 years. For couples, it was previously only possible for married couples, for more than two years, and over 28 years. Unmarried couples had to resort to the single parent adoption procedure.

Finally, this new booklet introduces the possibility, if the parents so wish, of declaring forenames and surname for a child born lifeless (who could previously be declared, but without a surname). On the other hand, it also makes it possible to record the death certificate of an adult child.

This new model of family booklet is put into circulation from 1er June 2022. The municipalities will be able to continue to issue old models of family books until their stock is exhausted.
