Pension reform: update on first decrees

These first two decrees (2023-435 and 2023-436), among the 31 planned for the reform, set out the detailed rules for the application of Articles 10, 11 and 17 of the Law on the Amending Financing of Social Security for 2023. Raising the age of pension entitlement
For insured persons subject to the common rule, the age is currently 62. It is increased to 62 years and 3 months for persons born between 1er September 1961 and December 31, 1961, and must increase by one quarter per year of birth, i.e. 64 years for persons born from 1er january 1968.
The deferral also concerns persons benefiting from exemptions. Officials engaged in arduous or dangerous occupations falling within the categories ‘ super-active and " active ' the minimum age of which will be increased by:

- 57 to 59 years for the second category (nursing assistants, etc.).
Long Careers

- 62 if you started working at 20;

Insured persons with disabilities
The rules on insured persons with disabilities are clarified, with a departure at 55 years and a relaxation of the conditions for departure as such. The necessary insurance period does not increase and the double condition of quarter validated and contributed is deleted in favor of maintaining the sole condition of quarters contributed. The decree introduces the creation of a retirement age of 62 for unfit and disabled insured persons.
Accident at work The pension scheme for permanent incapacity has been adapted to enable self-employed workers who have taken out individual voluntary insurance (AT/MP) to access it.
