Snowfall and absence or delay at work: what consequences for employees?

As the first snowfall arrives in France, some employees may not be able to get to their place of work in the coming days while others may also be late. But are workers being punished? Responses from Service-Public.fr.

In the event of bad weather (storms, heavy snowfall, etc.), the absence or delay of the employee cannot be considered as a fault if it is impossible for him to go to work (impracticability of roads for example).

However, in such circumstances, the employer is not obliged to pay the employee's time off (unless there is a more favorable collective agreement or agreement).

The amount deducted from the employee's pay must, however, be strictly proportional to the duration of the absence.

In order to avoid a withholding of wages, the employer may also offer the employee:

  • to recover his absence hours;
  • or to spend his absence on his paid leave or, if so granted, on his working days reduced (RTT);
  • or to allow the employee to take compensatory rest linked to overtime;
  • or telework.

Please note

When an employee is unable to go to work or to arrive on time due to bad weather (storm, heavy snowfall...). Force majeure (an exceptional, unforeseeable and irresistible event justifying the discharge of an obligation, commitment or responsibility).
