Notary fees: transfer fees increase in some departments

As of 1er in april, departments are authorized to increase the rate of transfer duties for consideration on sales of immovable property by 0.5 percentage points. This measure was incorporated into the 2025 budget to support community finances.

Notary's fees include all the sums requested by the notary in return for the service he performs. They include, in particular, in the context of real estate transactions, transfer duties for consideration (DMTO), a tax which belongs to local and regional authorities. The rates of this tax vary from one department to another, ranging from 3.8% to 4.5% of the transaction value.

The 2025 budget allows departments to increase the DMTO ceiling by 0.5 percentage points (5% of the sales price) since 1er April, and this until april 30, 2028.

This measure must be discussed within each department, the increase in transfer fees being voted by the departmental councils. Some 30 communities will be affected as of April 2025.

Any deliberation voted on after April 15, 2025, can only take effect as of January 2026indicates the law (the final list of rates applicable in 2025 will therefore not be known until 15 April).

Please note

The law provides an exemption for a first acquisition of a principal residence or if you have not owned a home for at least 2 years. For these persons, transfer duties remain at 4,5 % for three years.
