Adult-Relay Contract

Wondering what the Adult-Relay contract allows? This contract aims, in particular, to improve relations between residents of certain neighborhoods and public services. The employee must be unemployed or have a job support contract. They must meet age and place of residence requirements. The employer must operate in the non-profit sector (example: association). We're giving you the regulations to know.

The purpose of this contract is to improve:

  • Relations between residents of priority neighborhoods and public services
  • Social relations in public or collective spaces.

The creation of this contract is the subject of an agreement between the employer and the State (prefect of department). Once this agreement is signed, a contract can be concluded between the employer and a beneficiary.

FYI  

The State shall pay annual aid of €22,810.61 to the employer. The aid shall be paid from the creation of the adult-bridge contract.

Employer

Adult-bridging contracts can be offered by the following employers:

  • Associations
  • private companies entrusted with the management of a public service
  • Local and regional authorities (municipality, grouping of municipalities, department, region) and their public establishments
  • Public schools (kindergarten, primary school, middle school, high school)
  • Hospitals
  • Public offices and low-cost housing organizations.

The employer is therefore active in the sector non-profit making.

Employee

To be in a relay adult contract, you must meet the following 3 conditions:

  • Have 26 years or older
  • Being unemployed or benefiting from CUI-CAE. If you are in CUI-CAE, you must break it to sign an adult-bridging contract
  • Reside in a city policy priority area or other city contract priority territory.

Activities concerned

These social and cultural mediation missions consist of in particular to:

  • To welcome, listen to, exercise any activity that contributes to the social bond
  • Inform and accompany the inhabitants in their efforts
  • Facilitating dialog between public services and users (in particular between parents and services for their children)
  • Improve and preserve the living environment, facilitate dialog between generations, strengthen parental function
  • Assisting in the resolution of small conflicts of daily life through mediation and dialog
  • Facilitate intergenerational dialog, support and strengthen parental function by supporting initiatives taken by or in favor of parents
  • Strengthen community life, develop initiative and project capacity in the neighborhood and city.

Prohibited activities

Relay adults may not:

  • To carry out an act relating to the maintenance of public order
  • Be employed in functions whose sole purpose is to provide services in the homes of persons (childcare, help with homework, assistance in the home of an elderly person...).

Warning  

Employers entrusted with a public service may not hire adult staff for tasks falling within their normal activities (babysitting, technical maintenance, social assistance, etc.).

According to the employer, the adult-shift contract may take the form of:

Regardless of its nature (CDD or CDI), the adult-bridging contract may be concluded:

  • Full-time
  • Or part-time (at least half-time).

Warning  

When it takes the form of a fixed-term contract, the contract shall include a trial period :

  • One month
  • And renewable once.

Adult relay contract may be terminated every year on its anniversary date (date of signature):

An employee whose contract is terminated by his employer under these conditions shall receive compensation equal to 10% the remuneration received during the last 18 months of performance of his contract of employment.

The employer who breaks the contract must notify the termination by registered letter with acknowledgement of receipt (RRA). The mail must be sent after a period of 2 free days according to the date of the pre-interview. The date of submission of the letter shall be the starting point of the notice.

An adult-relay contract in DTA can be broken according to same rules as a traditional DTA (pre-interview, notice).

The adult-relay contract in CSD is subject to the usual rules of early termination. Thus, it may be ruptured if

  • From gross negligence
  • From force majeure
  • Or of incapacity ascertained by the occupational doctor.

It can also be broken at the employee's initiative, when the latter justifies the signature of a CDI.

FYI  

Failure by the employer to comply with the provisions relating to the termination of the CDD entitles the employee to damages.
