Enhanced leave in the public service

If you are originating from overseas, and posted to mainlandunder certain conditions, regardless of your public service of origin, you may benefit from an enhanced leave every 2 years to return to your home territory. If you are official of the State, you can also benefit, under certain conditions, from enhanced leave if you are originally from metropolitan france and posted overseas, or if you are originally from an overseas territory and posted to another overseas territory. We detail the conditions for granting this leave according to your public service of origin (State - FPE, territorial - FPT, hospital - FPH).

What is the enhanced leave?
The enhanced leave is a specific leave that can be granted to you if you are official or contractor in DTADTA : Contract of employment of indefinite duration and if you find in one of 2 situations:
- You are posted to mainland and the center of your moral and material interests is located in an overseas department-region (Guadeloupe, French Guiana, Martinique, Reunion, Mayotte) or in a overseas collectivity (Saint-Barthélemy, Saint-Martin, Saint-Pierre-et-Miquelon, Wallis and Futuna Islands, French Polynesia) or New Caledonia
- Or you are posted to an overseas department-region (Guadeloupe, French Guiana, Martinique, Reunion, Mayotte) or Saint-Barthélemy, Saint-Martin or Saint-Pierre-et-Miquelon and the center of your moral and material interests is located in another overseas territory : Overseas department-region or overseas collectivity (Saint-Barthélemy, Saint-Martin, Saint-Pierre-et-Miquelon, Wallis Islands and Futuna, French Polynesia) or New Caledonia.
The enhanced leave consists of support, by your employer administration, of your transport costs to enable you to return regularly to your home overseas territory on leave.

What are the conditions to be met to benefit from the enhanced leave?
You must justify that the center of your moral and material interests is located in the overseas territory for which you are requesting support for your enhanced leave.
Your entitlement to leave is based on certain criteria, such as:
- Home of your father and mother or, if not, of your closest relatives (parents, brothers, sisters, children)
- Location of real estate property owned or leased by you
- Home before your entry into the administration
- Place of your birth
- Earlier benefit from enhanced leave
- Place where you hold bank, savings or postal accounts
- Municipality where you pay certain taxes, especially income tax
- Business or administrative assignments that preceded your current assignment
- Place where you registered to vote
- Frequency of your transfer requests to the relevant territory
- Frequency of your trips to the territory concerned
- Duration of your stay in the territory concerned
- Location of your residence and that of your family members, your degree of kinship, their age, their activities, and possibly their health status
- Place of birth of your children
- Place where you or your children have completed your schooling or studies
- Place of burial of your closest relatives
- Place of the center of moral and material interests of your spouse or Civil partnershipsCivil partnerships : Civil Solidarity Pact

How do I apply for enhanced leave?
You must submit your request for enhanced leave to your Human Resources Branch.

Each jurisdiction generally has its own enhanced leave application form.
Your application must be accompanied by documents justifying the center of your moral and material interests in the territory or you are requesting to go on leave:

The recognition by the administration of the establishment of the center of your moral and material interests in an ultramarine territory is valid for 6 years.
During this period of 6 years, you must make known any change of situation that may lead to an update, before the end of this period of 6 years, of the location of the center of your moral and material interests.
This period of validity of 6 years applies only to favorable decisions.
If recognition the establishment of the center of your moral and material interests in an ultramarine territory has been rejected, you can to renew each year your request.
If your employer authority refuses to grant you the enhanced leave, it must give reasons for its decision.
The refusal decision may be subject, within 2 months of the date of its notification of a ex gratia and/or hierarchical appeal and/or a litigation before the administrative court.
How long is the enhanced leave?
The maximum duration of the enhanced leave shall be 31 consecutive days (including Saturdays, Sundays and public holidays) to which travel times may be added.
If you are a teacher or work at a school or university training center, you must include the period of your enhanced leave in the period of your school or university vacation.
The enhanced leave may consist, within the limit of 31 days, of annual leave, RTT days and days saved in a time savings account.
You can also benefit from 2 days leave in addition to the 31 consecutive days of enhanced leave for transit times.
Such authorizations for absence for traveling time shall be granted subject to service requirements depending on the distance to travel to your home territory.
These leave authorizations shall be granted within one day for the outward journey and one day for the return journey.
How often can you request enhanced leave?
You can benefit from an enhanced leave every 2 years: you must prove that you have 24 months of uninterrupted service.
Only services performed as a magistrate, civil servant or contract agent of the State on a permanent contract are taken into account.
The 24-month period includes the enhanced leave period itself. Thus, the enhanced leave can begin before the entitlement date.
The right to enhanced leave shall be acquired, at the earliest, from 1er day of 24e month of uninterrupted service.
The duration of the enhanced leave of 31 days shall be within 24 months.
Example :
An official who took up his duties on 1er january 2023 is entitled to enhanced leave from 1er January 2025. He can take it as early as the 1er December 2024.
24 months of uninterrupted service is calculated all public employers combined.
Uninterrupted periods of service taken into account are periods completed in position of activity or secondment.
Your services are counted from the date of your appointment as an intern (or your tenure where it is not preceded by an internship).
Periods completed on a part-time basis shall be treated as periods completed on a full-time basis.
Periods completed on an incomplete or incomplete basis also, if the working time is at least equal to half-time.
If the working time is less than half-time, these periods of incomplete or incomplete working time shall be taken into account in proportion to the working time.
The training periods and leave periods following are taken into account in the calculation of the 24 months :
- Previous Vacation and Enhanced Leave
- Sick or long-term sick leave (SICK LEAVE)
- Leave for temporary invalidity attributable to service (Citis)
- Maternity or adoption leave
- Paternity and childcare leave
- Parental leave
- Vocational training leave
- Leave for validation of experience
- Skills Check Leave
- Leave for union training
- Family Solidarity Leave
- Caregiver leave
- Representation leave
- Leave to practice on reserve.
Other leave (e.g. long-term leave, sick leave, parental leave, etc.) temporarily interrupts the counting of the 24-month period.
Months of service recorded prior to the leave not taken into account shall not be lost.
Example :
An official who took up his duties on 1er January 2023, placed on parental leave for 6 months on 1er may 2023 to october 31, 2023 is entitled to enhanced leave from 1er July 2025. He can take it as early as the 1er June 2025.
If you have children in school, your administration may authorize you to take your enhanced leave as from 1er day of 19e month of service if this anticipation allows you to make your enhanced leave coincide with the school holidays.
You may also be authorized to postpone your enhanced leave within 12 months of the decision granting you leave.
In this case, the leave must therefore be taken before the last day of 36e month.
If you come from an overseas territory and are posted to a DromDrom : Overseas Department and Region, in Saint-Barthélemy, Saint-Martin or Saint-Pierre-et-Miquelon, you may only be entitled to one cover of your travel expenses if, during the same year, you can benefit from an enhanced leave and you must take the admission tests of an examination or competition held in mainland France.
Where, during the same year, you are entitled to travel expenses incurred as a result of an illness or a traineeship to travel outside your territory of employment and you are entitled to enhanced leave, only your travel incurred as a result of the illness or traineeship is covered.
A period of 12 months must necessarily elapse between the date of return of a supported journey and the date of departure of the next supported journey.
In the event of overlapping of travel in the same year, travel expenses related to the enhanced leave shall not be covered.
What are the travel costs borne by your employer's administration?
You are entitled, from your employer's administration, to full payment of your return air transport costs and those of your dependent children for family benefits.
The transport costs of your spouse are also fully supported, if its resources are less than €18,552 gross per year. The amount of your spouse's resources taken into account is his reference tax income the year preceding the year in which you are entitled to your enhanced leave.
You can take advantage of these supports, subject to service requirements, within 12 months of the 24 months of interrupted service entitling you to the enhanced leave.
Travel expenses are paid on the basis of the most economical fare in force.
The transport costs covered are the round trip costs from the international airport of embarkation to the international airport of disembarkation.
Transport costs within the Dom or in mainland France are not covered.
Example :
If you live in the Paris region and you are going to Guadeloupe, the flight between Orly (or Roissy) and Pointe-à-Pitre will be taken care of. You are responsible for your own transport to and from the airport and airport/place of stay.
Luggage costs are covered up to a maximum of 40 kg per person.
Excess baggage is taken care of if the total weight of the baggage does not exceed 40 kg per person.
How is the enhanced leave paid?
During your enhanced leave, you continue to receive your regular salary.
You also touch a additional remuneration called cost-of-living allowance.
The amount of this allowance depends on where you leave.

The cost of living allowance is paid from the day after you disembark until the day before you board.
If you get a residence allowance, she cease to have paid you during your enhanced overseas leave.

Where, during the same year, you are entitled to travel expenses incurred as a result of an illness or a traineeship to travel outside your territory of employment and you are entitled to enhanced leave, only your travel incurred as a result of the illness or traineeship is covered.
A period of 12 months must necessarily elapse between the date of return of a supported journey and the date of departure of the next supported journey.

- The center of your moral and material interests is located in an overseas department-region (Guadeloupe, Guyana, Martinique, Reunion, Mayotte) or in Saint-Barthélemy, Saint-Martin or Saint-Pierre-et-Miquelon
- You practice in the metropolis.
Enhanced leave is the assumption by your employer authority of your transportation costs to enable you to return to your home overseas territory on a regular basis.

During your enhanced leave, you continue to receive your regular salary.
You also receive a compensation supplement called cost-of-living allowance.
The amount of this allowance depends on where you leave.

The cost of living allowance is paid from the day after you disembark until the day before you board.
If you receive a residence allowance, it ceases to be paid to you during your enhanced overseas leave.
FPH
Enhanced leave is a specific leave that can be granted to you if you meet the following 3 conditions:
- You're a public servant in the FPH
- The center of your moral and material interests is located in an overseas department-region: Guadeloupe, Guyana, Martinique, Reunion, Mayotte
- You practice in the metropolis.
The enhanced leave consists of your employer administration covering your transport costs to enable you to return regularly to leave in your home overseas department.
FYI
Guadeloupe and Martinique are considered to form the same community.
You must justify that the center of your moral and material interests is located in the overseas territory for which you are requesting support for your enhanced leave.
Your entitlement to leave is based on certain criteria, such as:
- Home of your father and mother or, if not, of your closest relatives (parents, brothers, sisters, children)
- Location of real estate property owned or leased by you
- Home before your entry into the administration
- Place of your birth
- Earlier benefit from enhanced leave
- Place where you hold bank, savings or postal accounts
- Municipality where you pay certain taxes, especially income tax
- Business or administrative assignments that preceded your current assignment
- Place where you registered to vote
- Frequency of your transfer requests to the relevant territory
- Frequency of your trips to the territory concerned
- Duration of your stay in the territory concerned
- Location of your residence and that of your family members, your degree of kinship, their age, their activities, and possibly their health status
- Place of birth of your children
- Place where you or your children have completed your schooling or studies
- Place of burial of your closest relatives
- Place of the center of moral and material interests of your spouse or Civil partnershipsCivil partnerships : Civil Solidarity Pact
These criteria are neither exhaustive nor cumulative.
You must submit your request for enhanced leave to your Human Resources Branch.

Each jurisdiction generally has its own enhanced leave application form.
Your application must be accompanied by documents justifying the center of your moral and material interests in the territory where you are applying for leave.

The recognition by the administration of the establishment of the center of your moral and material interests in an ultramarine territory is valid for 6 years.
During this period of 6 years, you must make known any change of situation that may lead to an update, before the end of this period of 6 years, of the location of the center of your moral and material interests.
This period of validity of 6 years applies only to favorable decisions.
If recognition from the establishment of the center of your moral and material interests in an ultramarine territory has been rejected, you can to renew each year your request.
If your employer authority refuses to grant you the enhanced leave, it must give reasons for its decision.
The refusal decision may be subject, within 2 months of the date of its notification of a ex gratia and/or hierarchical appeal and/or a litigation before the administrative court.
The maximum duration of the enhanced leave shall be 31 consecutive days (including Saturdays, Sundays and public holidays) to which travel times may be added.
If you are a teacher or work at a school or university training center, you must include the period of your enhanced leave in the period of your school or university vacation.
The enhanced leave may consist, within the limit of 31 days, of annual leave, RTT days and days saved in a time savings account.
You can also benefit from 2 days leave in addition to the 31 consecutive days of enhanced leave for transit times.
Such authorizations for absence for traveling time shall be granted subject to service requirements depending on the distance to travel to your home territory.
These leave authorizations shall be granted within one day for the outward journey and one day for the return journey.
You can benefit from an enhanced leave every 2 years: you must prove that you have 24 months of uninterrupted service.
Only services performed as a magistrate, civil servant or contract agent of the State on a permanent contract are taken into account.
The 24-month period includes the enhanced leave period itself. Thus, the enhanced leave can begin before the entitlement date.
The right to enhanced leave shall be acquired, at the earliest, from 1er day of 24e month of uninterrupted service.
The duration of the enhanced leave of 31 days shall be within 24 months.
Example :
An official who took up his duties on 1er january 2023 is entitled to enhanced leave from 1er January 2025. He can take it as early as the 1er December 2024.
24 months of uninterrupted service is calculated all public employers combined.
Uninterrupted periods of service taken into account are periods completed in position of activity or secondment.
Your services are counted from the date of your appointment as an intern (or your tenure where it is not preceded by an internship).
Periods completed on a part-time basis shall be treated as periods completed on a full-time basis.
Periods completed on an incomplete or incomplete basis also, if the working time is at least equal to half-time.
If the working time is less than half-time, these periods of incomplete or incomplete working time shall be taken into account in proportion to the working time.
The training periods and leave periods following are taken into account in the calculation of the 24 months :
- Previous Vacation and Enhanced Leave
- Sick or long-term sick leave (SICK LEAVE)
- Leave for temporary invalidity attributable to service (Citis)
- Maternity or adoption leave
- Paternity and childcare leave
- Parental leave
- Vocational training leave
- Leave for validation of experience
- Skills Check Leave
- Leave for union training
- Family Solidarity Leave
- Caregiver leave
- Representation leave
- Leave to practice on reserve.
Other leave (e.g. long-term leave, sick leave, parental leave, etc.) temporarily interrupts the counting of the 24-month period.
Months of service recorded prior to the leave not taken into account shall not be lost.
Example :
An official who took up his duties on 1er January 2023, placed on parental leave for 6 months on 1er may 2023 to october 31, 2023 is entitled to enhanced leave from 1er July 2025. He can take it as early as the 1er June 2025.
If you have children in school, your administration may authorize you to take your enhanced leave as from 1er day of 19e month of service if this anticipation allows you to make your enhanced leave coincide with the school holidays.
You may also be authorized to postpone your enhanced leave within 12 months of the decision granting you leave.
In this case, the leave must therefore be taken before the last day of 36e month.
Where, during the same year, you are entitled to travel expenses incurred as a result of an illness or a traineeship to travel outside the metropolitan area and you are entitled to an enhanced leave, only your travel incurred as a result of the illness or traineeship is covered.
A period of 12 months must necessarily elapse between the date of return of a supported journey and the date of departure of the next supported journey.
In the event of overlapping of travel in the same year, travel expenses related to the enhanced leave shall not be covered.
You are entitled, from your employer's administration, to full payment of your return air transport costs and those of your dependent children for family benefits.
The transport costs of your spouse are also fully supported, if its resources are less than €18,552 gross per year. The amount of your spouse's resources taken into account is his reference tax income the year preceding the year in which you are entitled to your enhanced leave.
You can take advantage of these supports, subject to service requirements, within 12 months of the 24 months of interrupted service entitling you to the enhanced leave.
Travel expenses are paid on the basis of the most economical fare in force.
The transport costs covered are the round trip costs from the international airport of embarkation to the international airport of disembarkation.
Transport costs within the Dom or in mainland France are not covered.
Example :
If you live in the Paris region and you are going to Guadeloupe, the flight between Orly (or Roissy) and Pointe-à-Pitre will be taken care of. You are responsible for your own transport to and from the airport and airport/place of stay.
