Can we retract after signing a house lease?
Verified 06 May 2024 - Directorate for Legal and Administrative Information (Prime Minister)
No, it is not possible to withdraw after signing a residential lease.
After the lease is signed, the tenant or landlord may to terminate the lease subject to certain conditions:
- The tenant may terminate the lease at any time, subject to a period of notice. This time limit does not apply if the dwelling is endangered or unhealthy. But for this to happen, the tenant must first have notified the owner of the disorders found and have made the steps to oblige him to do the work.
- The owner can terminate the lease on the lease's expiry date and for certain reasons only, except in the case of serious breaches by the tenant (e.g. outstanding rent and charges)
- The owner who signed a mobility lease may not take over the dwelling until the lease expires, but does not have to give the tenant leave.
FYI
The social landlord (an organization that owns a social housing unit) can terminate the lease when the tenant does not comply with certain rules or no longer meets certain conditions.
