Part-time work of a public service contractor

You may be authorized, at your request, to work part-time for various reasons. Depending on the reason for which it is requested, part-time work is either legal (i.e. the administration cannot refuse it) or granted subject to service requirements.
What applies to you ?
State Civil Service (EPF)
If you have been employed for more than a year at full-time, you can apply to work part-time on the occasion of each birth or adoption.
Part-time work cannot be denied by your administration.
If you are born, you have the right to work part-time until 3e your child's birthday.
In case of adoption, you have the right to work part-time for 3 years after the child arrives at your home.
How do I apply?
You can apply for part-time work at any time during the 3 years following the birth or adoption of your child.
You must submit your application in writing, specifying the date from which you want to work part-time and the duration.
There is no text setting the deadline for the submission of the application before the desired start date of the part-time period, nor the list of documents to be provided.
The application must generally be submitted 2 months in advance. Inquire with your human resources department.
Your administration may have prepared an application form and/or a list of supporting documents.

How is part-time organized?

Organization of work
Depending on the possibilities for organizing work in your department, part-time work may be organized under the following conditions:
- In a frame daily : working hours are reduced every day
- In a frame weekly : the number of days worked per week is reduced
- Within the framework of work cycle : the number of hours worked per cycle is reduced over a single day or over several days
- In a frame annual : the service is organized on calendar year (or for teaching and similar staff, over the school year).
Part-time shall be granted for one period from 6 months to 1 year, renewable, for the same period, by tacit renewal in the 3-year limit.
When it is organized within the annual framework, part-time shall be granted for 1 year, renewable twice by tacit renewal.
The decision of the administration shall indicate the alternation of periods worked and not worked and the allocation of working hours within the periods worked.

Your gross remuneration (index treatment, bonuses and allowances and residence allowance and family treatment supplement - SFT if you receive these 2 elements of remuneration) is reduced in proportion to your working hours.
However, if you receive the FTS, the amount of the FTS cannot be less than the minimum amount paid to a full-time employee with the same number of dependent children:
In the case of annualized part-time, your gross monthly remuneration is equal to 12e your gross annual remuneration, regardless of the distribution of periods worked and periods not worked.
Your commuting costs and your travel expenses shall be supported under the same conditions as for a full-time staff member.
You can work overtime.
However, the monthly number of overtime hours you can work is limited to 25 hours multiplied by your working time, such as 20 hours if you work 80% (25 hours x 80%).
Overtime shall be paid under the same conditions as for a full-time staff member.

Your commuting costs and your travel expenses shall be supported under the same conditions as for a full-time staff member.
You can work overtime.
However, the monthly number of overtime hours you can work is limited to 25 hours multiplied by your working time, such as 20 hours if you work 80% (25 hours x 80%).
Overtime shall be paid under the same conditions as for a full-time staff member.
In the case of half-salary during sick leave, half-salary is calculated on the basis of your full-time salary.
What are the effects of part-time work on your administrative situation?
Career and training
Your authorization to work part-time is suspended during maternity or adoption leave or during paternity and childcare.
It is also suspended during training if the education provided is incompatible with part-time work.
You are reinstated full-time for the duration of your leave or training.
Periods of part-time work shall be treated as periods of full-time work in the following situations:
- Reassessment of remuneration every 3 years
- Training rights where access to training is subject to a service seniority condition
- Calculation of the length of public service required to be eligible for internal competitions for admission to the public service
- Calculation of the length of service taken into account to determine your classification index if you are appointed as a probationary officer

You are entitled to the following leave:
- Annual leave equal to 5 times the weekly service obligations
- Leave for union training
- Training leave for youth leaders and youth workers
- Citizenship Leave
- Representation leave
- Vocational training leave
- Period of professionalization

- Leave to raise a child, care for a loved one, or follow a spouse who is forced to relocate for work reasons

Retirement
Part-time work periods are taken into account in calculating your number of pension insurance quarters provided your remuneration is at least equal to €1,747.50.
Warning
As a contract agent, you do not have the option of overpaying.
How is full-time readmission carried out?
At the end of the part-time period, you are re-admitted full-time to your position or to a similar position.
You can apply for full-time readmission before the scheduled end date of your part-time work.
You must apply at least 2 months before the desired date of full-time readmission.
In the event of serious grounds, such as a substantial reduction in your household income or a change in your family situation, you can apply for full-time readmission without delay before the scheduled date.
You can benefit from a part-time for therapeutic reasons under the conditions laid down by the social security sickness insurance.
You can benefit from a part-time company creation or take-back.
