Voluntary Severance Pay in the State Civil Service (EPF)

You are a public servant or a contractor in DTA: titleContent in the state civil service and you resign as a result of the restructuring or removal of your position? You can receive a voluntary severance payment under certain conditions. We present this device to you.
You can receive a voluntary severance pay when you choose to resign because of a restructuring of your job or the termination of your job during a restructuring of your service.
A staff member whose job is restructured benefits from various arrangements enabling him to find either a new job in the public service or, at his request, a job in the private sector.
A staff member whose employment is terminated shall be provided with various facilities enabling him to return to employment within the same administration or within another administration.
But in these 2 cases, the agent can also choose to resign. He can then receive a voluntary severance package.
A ministerial decree shall specify, at the time of each restructuring operation, the services, units, grades and posts concerned for which the allowance may be awarded and the period during which the voluntary severance allowance may be granted.
Voluntary severance pay may be granted to you whether you are a civil servant or a member of the contract staff DTA: titleContent.
You must be more than 2 years from the minimum retirement age on the date on which your request for resignation is sent, the postmark being authentic.
If you have signed an undertaking to serve the Crown at the end of a training period, you must have completed the full period of service provided by that undertaking.
The amount of the voluntary severance pay is 1/12e your annual gross remuneration, multiplied by your full years of actual service in the administration, up to a maximum of 24 times 1/12e.
The gross annual remuneration taken into account is that which you received during thecalendar year preceding the one in your request for resignation.
If you are on leave, on parental leave or on unpaid leave, the gross annual remuneration taken into account is that received during your last 12 paid months.
Example :
For a staff member with 15 years' service and annual gross remuneration of €25,000, the voluntary severance pay shall be €31,250 (25,000 / 12 x 15)
Bonuses and allowances granted on an ad hoc basis shall not be taken into account for the purposes of determining annual gross remuneration:
- Reimbursement of expenses
- Premiums and allowances change of residence, first-time assignment, related to geographical mobility and restructuring
- Teaching or jury allowances and other allowances not directly related to employment
- Residence abroad allowance
- Surcharges and indexing linked to an overseas assignment
The voluntary severance pay is paid in 1 installment once your resignation has become effective.
At your request, it can be paid in 2 installments over 2 consecutive years.
If you are re-recruited as a public servant or contract employee within 5 years of your resignation, you must pay back your voluntary severance pay.
This applies whether you are recruited into the state, territorial or hospital public service.
Reimbursement must be made within 3 years of your recruitment.
You can collect unemployment benefits if you meet the conditions to take advantage of it.
