Resignation, dismissal: can we work elsewhere before the end of the notice period?
Verified 06 August 2021 - Directorate for Legal and Administrative Information (Prime Minister)
Yes, subject to conditions.
You may not start working for a new employer before the end of your notice (for resignation or termination).
Therefore, you can only take advantage of this option in 2 cases:
- Your employer gives you a partial or total waiver of notice (written notice is recommended to prevent any dispute)
- Of treaty provisions or groups provide for it
In any other case, you must give notice. If your notice is not given, you may be ordered by the judge to pay your employer:
- A compensatory allowance equal to the amount of the period of work not performed
- Of damages
