Voluntary severance pay in the F/P/T

Are you a territorial agent and your position is being restructured? You may receive a voluntary severance payment under certain conditions if you decide to resign as a result. We will detail the conditions for the award of this compensation.

You can receive a voluntary severance payment if the following 2 conditions have been completed:

  • Your position is being restructured during a service reorganization and you choose accordingly to resign
  • There was a deliberation to provide a voluntary severance package in your community.

The deliberation is taken after the opinion of the social committee.

The deliberation shall determine the services, job managers and grades concerned by the restructuring of the service and for which the voluntary severance pay may be awarded.

It shall also lay down the conditions for the award and the amount of the severance pay.

In the absence of deliberationHowever, you are not eligible for the voluntary severance pay.

You can claim the voluntary severance pay if you complete the following 2 conditionss:

  • You are an official or contract agent in DTADTA : Contract of employment of indefinite duration
  • You are more than 5 years from the minimum retirement age on the date of sending your request for resignation (the postmark being authentic).

The steps to submit your resignation and request the voluntary severance pay are determined by each community.

Your community needs to specify what form the claim should take and when it should be made.

Before accepting your resignation, your employing community must verify that you meet the conditions to receive the compensation.

If you do not qualify for the severance, your employing community must inform you that you will not be eligible for the severance if you continue to resign.

The amount of the voluntary severance pay is determined on a case by case basis, within the framework set by the deliberation, and may vary according to your seniority in the administration.

The amount of compensation may not exceed one maximum amount equal to 2 times your annual gross remuneration received in the calendar year preceding your resignation.

The allowance is paid in one go once the resignation has become effective.

It is subject to the following contributions:

The allowance is taxable.

You do not have to be again recruited as a probationary official or contract staff in the public service (State, territorial or hospital) within 5 years of your resignation.

Otherwise, you must repay your voluntary severance, within 3 years of your recruitment, to the local authority that paid it to you.
