Social housing: solidarity rent supplement (extra rent)

A solidarity rent supplement (SLS) called overrent may be claimed from the tenant when the total income of the persons living in the dwelling exceeds by at least 20% the maximum income to be respected for the allocation of social housing. These amounts differ according to whether the dwelling is located in Île-de-France, in the province or overseas. We'll explain.

Île-de-France

You are obliged to pay extra rent if the total annual income of the persons living in your dwelling exceeds at least 20% the maximum income for the allocation of social housing of the same type as yours (PLS, PLUS or PLAI).

The annual amount of your rent (excluding expenses) plus the annual amount of the overrent may not exceed 30% of the total annual income of the persons housed.

Annual survey of the lessor

Overrent (SLS) due from 1er January (from year N+1) is calculated by the lessor during the previous year (or year N).

The landlord first conducts a resources survey to find out if you are liable for the overrent. The questionnaire will be distributed to you on the 2nde half of year N.

Within one month, you must complete the questionnaire and provide the following documents:

  • Last tax notice of each person living in the dwelling
  • If necessary, Mobility Inclusion Card marked invalidity.

For example, for overrents due from 1er january 2025, the survey is conducted in 2024 and tenants must provide the 2024 tax notice (covering their 2023 revenues).

On the basis of this information, the lessor calculates the amount of the overrent due. It provides you with information to verify the amount of overrent charged.

Please note

The landlord is not obliged to send you the resources survey if you are receiving housing assistance (APL : APL : Customized housing assistance, ALF : ALF : family housing allowance or SLA : SLA : Social housing allowance).

No response to annual survey

You have an obligation to respond in a period of one month.

If you don't, the lessor sends you a formal notice. No response within 15 days, you must pay a higher rent and pay a claim fee for €25.

Upon receipt of the information by the social landlord, the social landlord regularizes your overrent situation. The overpayment is returned to you within 2 months.

If you do not respond to the resources survey for 2 consecutive years, you must leaving your home (with exceptions).

In the event of a drop in revenue

Reminder

The extra rent due to the 1er January of year N is calculated in year N-1 on the basis of the resources received in N-1.

If your revenues drop, you can tell your landlord to recalculate the amount of your overrent.

Your landlord will apply a new overrent amount if you respond to 2 following conditions :

  • Your resources of year N or your resources for the past 12 months are at least 10% less than those for year N-1
  • You ask him to do so in support of supporting documents.

The new amount applies from the month following the month in which your income fell, provided that you have submitted the supporting documents within 3 months after this event.

If you send the documents after this 3-month period, the new amount applies from the month following your dispatch.

When the people housed change

If the composition of your family changes (for example, the birth of a child), you can tell your landlord to recalculate the amount of your overrent. To do this, you must provide at least one supporting document.

The new overrent amount will be applicable from the month following the month in which the change occurred, provided that you submit the supporting documents within 3 months after this event.

If you submit these documents after this deadline, the new amount will apply from the month following the submission.

Calculation Rule

The overrent is calculated with the following figures:

  • Living area of the dwelling (HS) in m2
  • Resource ceiling overshoot coefficient (RBFC) allocation of social rental housing (CDPR).
  • Reference Rent Supplement (SLR), i.e. the amount in euros per m² of living space. This amount shall be determined according to the geographical area of location of the dwelling.

The monthly amount of the overrent is calculated according to the following rule: Overrent = SH x CDPR x SLR.

Resource Ceiling Overflow Factor Value

Depending on the geographic area of your dwelling, the CDPR value to be applied may be different from the general CDPR value. Check with your landlord.
