Who receives family allowances for a child in alternate care?

Family allowances are paid differently depending on whether the parents are whether or not agreement is reached on the beneficiary or beneficiaries.
Alternate residence may only concern children alternatively resident at the home of each of their parents in one of the following situations:
- The Family Court (JAF) has established the residence of the child alternating with the home of each of his parents. Alternating residence is implemented effectively
- In the case of an alternate declaration of residence made jointly by the 2 parents
- In the case of an alternate declaration of residence made by one parent and not contested by the other.
FYI
If you have only one dependent child, you are not entitled to family allowances and therefore cannot claim them, except in Dom.
Agreement
In case of alternate residence of your children, you the choice. You can:
- Designate the parent who will be the beneficiary of all the family benefits
- Or choose to share family allowances and designate 1 single beneficiary (you or the other parent) for other family benefits. In choosing the division of family allowances, each parent receives half of the amount.
Example :
A father has three children in alternate residence for whom he receives only the sharing of family allowances. The mother of the children is the recipient of the other family benefits.
In order to declare the option selected, it is necessary to distinguish whether you are at the CAF or the MSA.

Warning
You can only change your choice after1 year (unless your children's residence conditions change). At the end of this 1 year period, this choice is tacitly renewed if you do not take steps.
Disagreement
If you disagree with the other parent, you automatically receive a share of the family allowances, as well as for the other parent.
This share depends on the composition of your family.
Other family benefits continue to be paid to the parent who received them before the separation or divorce.
For the declaration, it is important to distinguish whether you are at the CAF or the MSA.
