Car insurance: is the accident with a wild animal compensated?

In the event of a traffic accident with a wild animal, you can be compensated by your car insurance, by your individual accident insurance or by the Guarantee Fund of Compulsory Damage Insurance (FGAO). We present the applicable rules.

An accident with a wild animal is an accident in which your vehicle collided with a wild animal, an animal without an identified owner or an animal whose owner is not insured.

If you have a collision with a wild animal, you have to make the accident known and try to collect the evidence.

You must go to the police or gendarmerie as soon as possible to report the accident.

Then, you must make a claim declaration to your insurer within the time limit set out in the contract. It is generally 5 working days.

You must pass on to the insurer the evidence you have collected (testimonies of your passengers or third parties, photos, videos, police or gendarmerie minutes, etc.).

The material damage to your vehicle in an accident with a wild animal can be compensated by your car insurance, if you have purchased the hardware damage warranty or the all-accident guarantee.

You can only be compensated for damage to your vehicle if you have purchased one of these optional warranties.

Please note

The insurer must not apply any malus following the accident with a wild animal if you demonstrate that it is a force majeure.

Personal injury is injury, the consequences of injury (temporary or permanent incapacity for work) and death.

As a driver, you can be compensated for personal injury resulting from the accident with a wild animal.

The coverage of your compensation varies depending on whether or not you have taken out insurance that covers your personal injuries (driver's or individual accident insurance).

You must make a claim for compensation from the insurance that covers your personal injury.

If your personal injuries are not fully compensated by the insurance covering them, you can apply for additional compensation from the Victims Guarantee Fund.

You can ask your insurer to help you build your file, as part of your defense-recourse guarantee. You can also send your claim directly to the Guarantee Fund. In all cases, you must ensure that your file reaches the Guarantee Fund within 3 years of the accident.

If your personal injuries are not fully compensated by the insurance covering them, you can make a supplementary claim to the Compulsory non-life insurance guarantee fund (FGAO).

The file with the FGAO must be submitted within 3 years of the accident, with the following form:

Claim for compensation from the FGAO by a victim of a traffic or hunting accident

You must send the completed form with supporting documents to the FGAO.
