Car rental: do you need to take out insurance?
Verified 02 February 2024 - Directorate for Legal and Administrative Information (Prime Minister)
No, because the rental business has an obligation to insure the vehicles rented with the compulsory civil liability guarantee.
The price of this insurance is included in the cost of the rental. In addition, the rental business must provide you with supporting documents regarding liability insurance.
But be aware that liability insurance covers you only for any damage you may cause to a third party. It does not cover you for any injuries you may suffer as a driver, or for damage to the vehicle or theft.
That is why the rental businesses offer additional insurance that is negotiated with their partner insurers to cover these risks.
These supplementary insurance is optional and the rental business must provide you with the information to allow you to choose:
- Conditions of application of the guarantees (elements covered and cases of limitation or exclusion of guarantees)
- Amount of deductibles and situations in which they apply
- Rates and conditions for optional insurance
Before signing the lease, you should read it carefully and check the insurance included in the base price and optional insurance you have chosen.
Please note
If you have to drive the car outside of France, even for a short trip, you need to check if the insurance will cover you. If not, you will need to take out a special optional insurance.
If you have not taken out additional optional insurance, you may be required to cover certain expenses in the event of an accident or theft:
- Costs of repairing damaged vehicle following an accident
- Costs of injury to the driver of the vehicle in the event of an accident
- Reimbursement of the new value of the vehicle in the event of theft
However, if you cause damage to others, liability insurance will cover the compensation.
If you have not taken out additional optional insurance and the car is stolen, the rental business can claim a refund of its new value.
Additional insurance may cover you for well-defined risks not covered by the civil liability guarantee: vehicle damage, driver injuries, theft of the vehicle, assistance.
At the time of rental, the business must provide you with the following information regarding optional insurance:
- Conditions of application of the guarantees (elements covered and cases of limitation or exclusion of guarantees)
- Amount of deductibles and situations in which they apply
- Rates and conditions for optional insurance
You must read the lease agreement carefully and check the guarantees offered in the optional insurance, as well as their conditions of application.
If you take out some of these optional insurance policies, the rental business must provide you with supporting documents.
In the event of a loss, the insurance will cover the compensation, but it may ask you to pay a deductible if provided for in the contract.
