What is the Commission on Health, Safety and Working Conditions (CSSCT)?

The CSSCT is a commission set up within the Social and Economic Committee (ESC). In which companies or establishments should it be setting up ? How to is it being implemented? What are its members, its assignments, the participants at meetings? We're doing an update on the regulations.
The regulations are different depending on the number of staff of the company or its exhibition to special risks (nuclear facilities, site Seveso high threshold, for example).
300 or more employees
A CSSCT is obligatory in companies and establishments separate if the number of at least 300 employees.
This effective must be reached during 12 consecutive months.
A CSSCT power station is also obligatory if the company has more than 300 employees and has 2 establishments distinct, whether the number of employees in these establishments is less than, equal to or greater than 300.
The CSSCT shall exercise, by delegation of Social and Economic Committee (ESC), all or part of the duties of the Committee on the health, the safety and working conditions.
In the areas of health, safety and working conditions, the CSSCT is competent, for example, on:
- Analysis of occupational risks workers, including pregnant women, may be exposed to
- Improvement of access to women to all jobs and the resolution of maternity-related problems
- Adaptation and fitting-out workstations to facilitate access to and maintenance of persons with disabilities to all jobs during their working life
- Proposal for any initiative it considers useful, including prevention of psychosocial risks

The implementation of a or several CSSCT is performed by company agreement negotiated with a shop steward.
On the insideabsence as a shop steward, this implementation is possible by agreement between the employer and ESC: titleContent. This agreement is to be adopted by majority of members elected incumbents.
Where no agreement has been reached, the employer may decide set up one or more CSSCTs.
In this case, the rules and regulations of the ESC shall determine the conditions setting up the CSSCT (number of members, missions, operation and resources allocated, specific training).
The CSSCT is presided by the employer or its representative.
It counts for at least 3 staff representatives who must be members of the ESC: titleContent.
At least 1 representative must belong to the college technician, master's officer and manager or if necessary 1 at the framework college (holder or alternate) according to the company's staff.
CSSCT members are protected employees.

The employer can to be assisted by collaborators belonging to the company and chosen outside the ESC. Together, they may not exceed the number of representatives of the full staff.
The entire delegation of CSSCT staff to the CSE shall benefit from a training health, safety and working conditions.
In addition to the employer and the CSSCT members, the following persons may to attend CSSCT meetings:
- Members of the delegation from staff to ESC: titleContent
- Occupational physician or the member of the multidisciplinary team of the occupational health and prevention service
- Internal manager or agent in charge of safety and working conditions
- Control Agent for labor inspection and agents of the prevention services of social security bodies
Less than 300 employees
In companies or separate establishments of minus of 300 employees, the CSSCT is not not obligatory. However, it is possible establish a CSSCT.
The labor inspector may impose the creation of a CSSCT, if this is necessary, in particular because of the nature of the activities, of the layout or the facilities the premises.
He can to impose it in a establishment of minus of 50 employees belonging to to a company of plus 50 employees.
It cannot impose it in a company of minus 50 employees.
This decision may be disputed in front of Dreets: titleContent or before the administrative tribunal during a litigation.
When the CSSCT is set up, it obeys the same rules in a company or establishment of plus 300 employees.

Companies at particular risk
A particular risk company or institution is a company or institution in which the following characteristics are present:
- Presence of at least one nuclear facility basic
