Transfer of building permit, development permit or advance work declaration

Are you buying or selling land for which a building or development permit or prior notification has already been granted? Buying or selling a property under construction? You can change the license holder by requesting the transfer of the seller's city planning authorization to the buyer. The city council authorizes this transfer under certain conditions. We are taking stock of the situation.

The transfer authorization is granted when the following 3 conditions are met:

Any change in the city planning rules between the initial permit and its transfer cannot result in a refusal by the City Hall.

Warning  

Transfer to a legal person This is possible if the plans for the initial building permit have been drawn up by an architect.

You must submit your transfer request to the town hall:

  • By dematerialized according to the arrangements made by your municipality (inquire on the site of the town hall or on the spot)
  • By letter RARRAR : Recommended with notification of receipt
  • In your own hand

Warning  

In a commune of more than 3,500 inhabitants, a legal person shall forward its request for authorizationcity planning authorization only electronically.

You must submit your transfer request to the BasuBasu : Welcome desk and service to the user by dematerialized means :

The decision shall be given within 2 months.

The absence of a written decision from the city hall means that it authorizes the transfer.

The new holder shall post the permit or advance declaration on their land.

The all of the tax and duty obligations and rights associated with the city planning authorization are transferred to you as a new holder.

You are liable for taxes and participations (e.g. development tax, participation for roads and networks - PVR, preventive archeology fee - RAP).

To find out the amounts to be paid, you must contact the property tax center.

Who shall I contact

You can be sued by the City Hall if you do not comply with the city planning authorization granted and transferred.

You can also be sued by your neighbor if your construction causes him harm.
