Can the insurer terminate a home insurance contract after a claim?
Verified 11 March 2022 - Directorate for Legal and Administrative Information (Prime Minister)
Yes, your insurer can terminate the home insurance contract after a loss, even if you did not cause it. But it has to be in the terms and conditions of the contract.
If the insurer wants to terminate the contract for this reason, it must notify his decision.
Termination will take effect 1 month after notification.
The insurer must reimburse you for the contributions that correspond to the period between the termination date and the original due date.
If your insurer terminates your home insurance contract after a loss, you can then terminate all other insurance contracts with your insurer, without complying with the normal termination periods.
You must notify him of your decision within 1 month after the termination of your home insurance contract, by registered letter or by electronic registered mail. Termination will take effect 1 month after notification.
Warning
the insurer may no longer terminate the contract if, 1 month after being informed of the claim, he has accepted payment of a contribution or a part thereof corresponding to the period after the claim.
