Does a young employed father have protection against dismissal?

Yes, the young father is protected against dismissal during the 10 weeks who follow the birth of their child.

This protection applies regardless of the relationship between the child and the mother (marriage, Civil partnerships, etc.).

The employer may dismiss the employee if it justifies of a gross negligence or an inability to keep his contract of employment for a foreigner reason upon the arrival of his child.

The inability to maintain the contract of employment may result, for example, from the incapacity of the employee, declared by the occupational doctor, with the impossibility of reclassification.
