Hourly allowances for additional work (IHTS)

Are you a Class B or C agent and you work overtime? These overtime hours may be paid by Hourly Extra-Duty Allowances (IHTS). We will detail the conditions for payment of these HITs according to your public service of origin (State - FPE, territorial - FPT, hospital - FPH).

Agents concerned

You can receive Hourly Extra Work Allowance (HWI) if you category B or C official or contract staff of the same level and performing functions of the same nature.

Ministerial Orders list the body, grades and jobs that can benefit from IHTS.

Definition of overtime

Overtime, paid by IHTS, is the hours worked at the request of the head of department beyond the time limits defined by the work cycle.

Overtime worked between 10pm and 7am shall be considered as overtime at night.

Overtime Count Modes

The payment of HITs depends on the establishment of automated control means working hours (scoring) to accurately account for overtime.

However, the payment of the HITs may be made on the basis of a statement for staff working outside their premises of employment.

Payment of the HITs may also be made on the basis of a statement for sites where the number of staff eligible to receive HITs is less than 10.

The number of overtime hours you can work is capped, except in exceptional circumstances. This ceiling varies depending on whether you are working full-time or part-time.

Full-time agent

You can perform maximum 25 hours overtime per month.

However, this monthly ceiling may be exceeded in the case of exceptional circumstances and for a limited time, by decision of your head of department. The staff representatives on the Social Committee must be informed of this.

The monthly ceiling may also be exceeded, exceptionally, after consultation of the Social Committee, for certain functions laid down by ministerial decree.

Part-time staff member

You can work a maximum of 25 hours of overtime per month multiplied by your work quota.

Example :

If you work part-time at 80%, you can work up to 20 hours of overtime per month (25 x 80%).

Part-time staff member

The IHTS amount is calculated as follows:

This amount does not vary regardless of how much part-time work you do, how much overtime you work, or when the overtime is worked (Sunday, holiday, night).

The thousandths of a euro cent should be ignored at each stage of the calculation.

Overtime can also be compensated by compensating rest. The same overtime shall not give rise to both compensatory rest and compensation.

IHTS are not cumulative steps with any other compensation of the same nature.

They may not be paid during the periods for which the travel expenses.

FPT

Agents concerned

You can receive Hourly Extra Work Allowance (IHTS) if you are in one of the following situations:

  • You are a category B or C civil servant or a contract staff member of the same level and performing similar functions
  • You report to job managers category A in the health and social sectors other than doctors and psychologists
  • You fall under the municipal police officer employment framework, the country guard employment framework, or the municipal police chiefs employment framework
  • You're a professional firefighter

The list of posts for which overtime is required to qualify for hourly allowances for overtime work shall be drawn up by each local authority by deliberation.

Please note

If you report to the job managers of arts teachers, special assistants and arts teaching assistants, you are entitled to compensation on the same terms as the State teaching staff if you work more hours per week than the maximum statutory service laid down in your Staff Regulations.

You can receive Hourly Extra Work Allowance (HWI) if you category B or C official or contract staff of the same level and performing functions of the same nature.

You can also benefit from the Hourly Extra Work Allowance (IHTS) if you report to a Class A body appearing on a list fixed by ministerial order.

Definition of overtime

Overtime, paid by IHTS, is the hours worked at the request of the head of department beyond the time limits defined by the work cycle.

Overtime worked between 21 hours and 7 hours shall be considered as overtime at night.

Overtime Count Modes

The payment of HITs depends on the establishment of automated control means working hours (scoring) to accurately account for overtime.

However, the payment of IHTS may be made on the basis of a statement of account for staff working outside their premises of employment.

Payment of the HITs may also be made on the basis of a statement for sites where the number of staff eligible to receive HITs is less than 10.

You can perform up to 240 additional hours per year.

If your work cycle duration is less than or equal to 1 month, you cannot work more than 20 hours of overtime per month.

If your work cycle duration is more than 1 month, you can perform a maximum of 240 hours of overtime per month divided by 52 weeks multiplied by the number of weeks in your work cycle.

If the continuity of service or the health situation so requires, your establishment may be authorized, by theARS: titleContent or the prefect of department, in exceptional cases, to use overtime. This remedy is authorized for a limited period and for the staff necessary to take care of the users.

If you are part of the staff assigned to organ harvesting and transplantation activities, overtime you work during periodic penalty payments are not taken into account in calculating your monthly overtime limit.

Overtime is usually paid hourly compensation for overtime work, including amount is increased when the hours are worked at night or on a Sunday or public holiday.

Since 1er december 2021 and for a period of 3 years, school heads may identify tension looms for which overtime is increased.

Please note

Overtime can also be compensated by compensating rest. The same overtime shall not give rise to both compensatory rest and compensation.

The conditions for recourse to compensation or compensation shall be laid down by the head of establishment after consulting the Social Committee.

The night and Sunday or public holiday surcharges do not accumulate.

Tensioned looms

Since 1er December 2021 and for a period of 3 years, the hourly overtime allowance may be increased (overcharged) for staff engaged in tension loom.

The head of establishment shall identify the occupations in tension within his establishment for which the overtime surcharge may be applied.

Tensioned looms can be freely designated by the head of the establishment.

They can also be designated from the following bodies :

  • Nurse anesthetists
  • Medical assistants practicing advanced practice
  • General and Specialized Nurses
  • Nurse anesthetists and nurses
  • Physical therapists, speech therapists and orthoptists of category A or B
  • Category A or B medical electroradiology manipulators
  • Midwives

Contract staff performing tasks equivalent to those of officials in those bodies shall be entitled to the same increase.

The provisions shall be submitted to the Social Committee for information.

This arrangement concerns overtime, worked day or night in the framework of additional days or half-days of work.

The duration of the days or half-days of additional work shall correspond to the duration usually carried out in the service in which the overtime is worked.

The number of overtime hours that can be overworked must be included between 10 and 20 hours on average per month over a 12-month period maximum.

Overtime can be more than 20 hours per month. But the actual weekly working time cannot exceed 48 hours in any 7-day rolling period (i.e. from date to date).

The following periods of leave shall not be taken into account for the calculation of the average monthly duration of 10 to 20 hours of overtime:

  • Ordinary sick leave
  • Sick leave
  • Long-term leave
  • Maternity leave
  • 3-day leave for birth or adoption
  • Adoption leave
  • Paternity and childcare leave
  • Vocational training leave
  • Leave for validation of experience
  • Skills check leave.
How to benefit from the surcharge?

In order to benefit from overtime, you must apply to your school manager under the conditions set out in your school.

You can apply for it whether you are a civil servant or a contract worker. You have to work full time.

Your head of establishment agrees and specifies the overtime package and the period of application applicable to you.

The overtime surcharge applies from 1er day of the month following the month of your agreement.

It ends automatically in the following cases:

  • The period of application of the scheme shall not be renewed
  • Change of duties or assignment
  • Suspension of duties
  • Termination of office
  • Force majeure

The overtime may also end one month after the manager receives your request.

It may also be terminated at any time, by reasoned decision of the head of school, one month after you have been informed.

An interview may take place when the surcharge is terminated at your request or upon the decision of the head of establishment.

How is the surcharge calculated?

Overtime shall be compensated monthly, taking into account the hours actually worked during the month.

This compensation is adjusted at the end of the period of application of the scheme to take account of the overtime package applicable to you.

For freely designated tensioned looms by the head of establishment, the amount of the allowance timetable shall be calculated as follows:

For designated tension looms by the head of the establishment among bodies listed by ministerial order, the amount of the allowance timetable shall be calculated as follows:

These amounts are doubled when overtime is worked at night.

They are increased by 2/3 when overtime is worked on a Sunday or public holiday.

If you fewer overtime hours than planned to your package, and if that is because of you, the amount of the allowance timetable shall be calculated as follows:

This amount is doubled for overtime at night and increased by 2/3 for overtime on Sundays or public holidays.

Your institution will ask you to repay the overpayment.

This rate of 1.26 is applied if you have worked less overtime than expected on your package for another reason the reasons for which the increase is automatically terminated.

If you fewer overtime hours than planned to your package, by your employer, your hourly allowance does not change.

If you more overtime than expected the amount of the compensation paid for each additional hour worked in excess of the lump sum is calculated as follows:
