Abusive telephone solicitation, voice or SMS spam: what to do?

Do you receive unwanted commercial telephone calls (known as abusive telephone solicitation), voice spam or SMS spam (unknown caller prompting you to call back a premium rate number)? Solutions exist to stop these disturbances. We present them to you.

Abusive telephone solicitation
We're talking about abusive telephone solicitation when you receive unwanted commercial telephone calls.
For example, a company calls you to sell you a telephone subscription.
Warning
a purely malicious call (insult, threat...) is the responsibility of the telephone harassment which is an offense. If you are prompted to call back a premium rate number, it is voice spam.
Register on Bloctel
If you do not wish to receive commercial telephone calls, you can register one or more of your fixed and/or mobile telephone numbers (up to 8 numbers) on an official list against abusive telephone solicitation Block :

This listing is free for all consumers.
Registration on Bloctel also allows you to report calls that you consider abusive.
This registration does not allow technically blocking abusive calls but professionals will no longer have the right to call you to canvass you, except in some cases.
If you change one or more phone numbers, you must unsubscribe the number(s) and register the new number(s) if you do not wish to be contacted.
Warning
Bloctel does not handle abusive SMS messages.
Check that the call is abusive
There are 4 cases where the law allows certain professionals to call you despite your registration on Bloctel. These are calls from:
- survey or survey institutes
- non-profit organizations
- professionals for the sale of newspapers, periodicals or magazines
- companies with whom you have an ongoing contractual relationship. These companies can call you if you are a customer at home and only if the commercial offer is relevant to your contract. This includes offers of products or services that are related to your contract or that are complementary to the subject of your contract or that are likely to improve its performance or quality.
However, these professionals must respect certain days and times to call you. Indeed, since the 1er march 2023, direct-dialing is permitted only Monday to Friday, 10.00 - 1.00 and 14.00 - 20.00. However, it is forbidden on Saturdays, Sundays and public holidays.
Furthermore, it is forbidden for the same professional or a person acting on his behalf to canvass you or try to canvass you by telephone more than 4 times during a period of 30 calendar days.
If you refuse to canvass on 1er appeal, the trader or the person acting on his behalf has the obligation to no longer contact you for a period of at least 60 days from your refusal.
The trader or the person acting on his behalf shall be liable to an administrative fine of €75,000(if it is a natural person) or €375,000(if it is a legal person).
FYI
any contract concluded as a result of a telephone solicitation carried out in breach of the registration on Bloctel is considered invalid and may be annulled in court.
At the beginning of each phone call, the professional must also give you the following information:
- His identity or the identity of the person on whose behalf he is calling
- The commercial nature of his appeal
This information must be given to you in a clear, precise and comprehensible manner.
Without such information, the trader may be liable to a fine of up to €15,000.
The trader's phone number must also be displayed or face a fine of up to €375,000. So he can't reach you in a hidden number.
Since 1er january 2023, direct-to-consumer platforms can no longer call you from numbers starting with 06 or 07 because they are associated in everyone's mind with mobile phones. They must use numbers starting with one of the following prefixes: 09 37, 09 38 or 09 39
Please note
any contract concluded with an operator of electronic communications services (telephony, internet, television) must include information about the possibility of registering for free on Bloctel. Without this information, the operator may be liable to a fine of €15,000.
You must report it on the Bloctel website by filling out a declaration form accessible from your personal area.
Your declaration is sent to the departmental services of the DGCCRFDGCCRF : Directorate-General for Competition, Consumer Affairs and Fraud Prevention carry out such investigations as they deem necessary.
If you continue to receive abusive calls despite the steps you have taken to block and unsubscribe from them, you can consider filing a complaint with the DGCCRFDGCCRF : Directorate-General for Competition, Consumer Affairs and Fraud Prevention or the CnilCnil : National Commission for Informatics and Freedoms.

Voice Spam
We're talking about Svoice pam when you receive a call with a number of type 089..., 081... or 082..., but that hangs up as soon as you take the call. It can also stay online for a few seconds.
If you have not picked up, the number will be recorded as a missed call.
The purpose of these calls is to get you to call back a surcharged number.
Such practices may be part of a attempted fraud.
We are also talking about Voice Spam if you get a call from a classic 01 40 number...but when you pick up, you're encouraged to call back a premium-rate number. It is also an attempt to defraud.
Warning
if your correspondent picks up and offers you a commercial offer, it is a telephone solicitation and not voice spam.
You can block the number of the correspondent by sending by SMS to the 33,700 a message containing the words Voice Spam followed by the number of your correspondent who prompts you to call him back.
The 33700 is the official platform to fight against voice and SMS spam.
An SMS message will be sent to you by the 33,700 to confirm the correct receipt of your report.
Sending a text message to 33,700 is free if you are a customer of one of the following operators:
- Auchan Telecom
- Bouygues Telecom
- CIC Mobile
- Cofidis Mobile
- Mobile Mutual Credit
- Free
- Mobile NRJ
- Orange
- SFR
For other operators, the service may cost the price of a normal SMS.
In addition, some applications offer to block voice spam themselves. Your operator can offer such an application.

When you report spam to 33700, the effect is not immediate. Handling spam requires the operator to have received multiple reports and take action that may take time to implement.

SMS Spam
Spam via SMS is an unwanted SMS. This text message prompts you to call back a surcharged number of type 089..., 081... or 082.... to pretend a win in a lottery for example. Such practices may be part of a attempted fraud.
You can also receive commercial offers by SMS without wanting to swindle you.
The company usually offers to send the message STOP by SMS to stop these SMS.
To block an unwanted message received via SMS, you must forward the message to the number 33700.

Use to report a phone number that is sending spam
Free for Bouygues Telecom, Orange, SFR, NRJ Mobile, Crédit Mutuel Mobile, CIC Mobile, Cofidis Mobile and Auchan Telecom customers.
When you report SMS spam to 33700, it is sent to the mobile operator that issued the number used for spam and to your mobile operator (if it is not the same). They can then conduct various shares :
- Cut the overcharged SMS number that SMS SPAM prompts you to send a message to
- Cut the premium phone number that SMS SPAM prompts you to call (number starting with 08, or 4-digit number starting with 3)
- Cut the sender number of SMS SPAM (number starting with 06, 07, or +336, or +337)
- In the most serious cases, a complaint may be lodged with the police services concerned.
The more reports there are, the more action the various players can take to combat SMS spam.
