Guarantee Visale: deposit for the tenant (unpaid and degradations)

What is the Visale warranty? It's a tenancy bond free, thatHousing Action granted for certain dwellings rented in mainland France or in Drom. To do this, the tenant must obtain the Action Logement visa and the landlord (lessor) must accept the bond. In case of rental damage or unpaid rents, Housing Action first pays the owner (lessor) the amount due, and then is reimbursed by the tenant. We'll explain.
The rules vary depending on the location of the dwelling to rent:
Île-de-France
The tenant and landlord (landlord) must not be members of the same family (grandparent, parent, or child).
The other conditions to be respected depend on the age of the tenant when signing the lease:

Tenant 30 years and under

The process takes place in several stages:
1. The tenant applies online
To request the Visale guarantee, the future tenant must create his personal space on the site Visale.fr:
Tenant: access his personal space on Visale.fr

The tenant must provide several supporting documents. The self-employed tenant must also provide specific documents.
2. Action Logement grants its visa
Action Logement checks whether the tenant complies with the conditions to obtain the Visale guarantee.
If so, Action Logement sends him a endorsement in a few working days.
The endorsement is used to prove to the owner (lessor) that the future tenant is eligible for the Visale guarantee.
3. The tenant gives the visa to the landlord (landlord)
The tenant can download and print the endorsement from its online personal account.
The tenant must hand it over to its future owner (landlord).
4. The owner (lessor) shall apply for the guarantee
The owner (landlord) must first create his personal space on the site Visale.fr :
Owner: access his personal space on Visale.fr
It then indicates the number of the endorsement, the name of the tenant and the characteristics of the accommodation.
A proposal for a guarantee is automatically created. The owner must validate it.
5. Signature of the lease
Once this has been done, the tenant and the landlord (lessor) can sign the lease, benefiting from the guarantee of Action Logement.
The unpaid amounts covered depend on the accommodation being rented:

The owner (lessor) must follow these steps:
1. From the 1st unpaid
Within 15 days of the unpaid, the landlord (landlord) must claim the rent from the tenant, by means of a notice to pay sent by registered letter with acknowledgement of receipt.
As soon as the unpaid amount exceeds the total of one month's rent and expenses (net of housing assistance), the owner (lessor) may report the unpaid amount to Action Logement from his personal online space.
Example :
For €450 monthly rent and €50 monthly charges,
- When the tenant does not receive housing assistance, it is possible to declare the unpaid amount as soon as it exceeds €450 + €50 = €500
- Where the tenant receives housing assistance from €120, it is possible to declare the unpaid amount as soon as it exceeds €450 + €50 - €120 = 380. €
After the owner (lessor) declares the unpaid amountand supporting supporting documents, Action Logement issues a subrogative receipt, which the owner (lessor) must validate online.
As soon as it is validated, receipt subrogative enables Action Logement to:
- To pay to the owner (lessor), within 5 working days, the amount of such receipt
- To recover from the tenant the amount of this receipt.
As long as the tenant has not paid all of his debt at Action Logement, the owner (lessor) must, from his personal online space, update monthly on tenant account, including where the tenant has resumed payment of the rent.

2. Where the tenant does not resume payment of the rent
Every month, the owner (lessor) must update, from personal online space, on tenant account and declare the new unpaid amount, as well as any amounts paid to him by the tenant.
This allows Action Logement to implement the recovery procedure and to cover the costs of this procedure. The recovery procedure may include termination of the lease and eviction of the tenant, if necessary.

The owner (lessor) is informed of the main steps of this procedure from his personal online space.
After recovering the accommodation, the owner (lessor) must
- Report to Action Logement the departure of the tenant
- And provide to Action Logement within 60 days, the balance of any account he has given to the tenant.

Action Logement offers a summary document time limits to be met by the owner (lessor).
Action Logement, after having paid the amounts due to the owner (lessor) within the limit of the amount taken over, recovers these amounts from the tenant.
The tenant repays Action Housing according to a timetable, which may be adjusted to take account of its financial situation. The tenant can apply for it within 2 months of the refund request, from his personal online space.
The tenant must pay his refunds from his personal online space.
Warning
When the tenant not on schedule of its refunds, Action Logement may apply to the judge for the termination the lease (i.e. the end of the lease).
After recovering the dwelling, the landlord (landlord) 60 days to ask Action Logement to take charge of the rental damage.
For this, from its personal online space, it must provide all supporting documents for degradation (inventory) and repair (invoice).
Action Logement issues a receipt subrogative, which the owner (lessor) must validate online.
As soon as it is validated, subrogative receipt enables Action Logement to:
- To pay to the owner (lessor), within 5 working days, the amount of such receipt
- To recover from the tenant the amount of this receipt.

The process takes place in several stages:
1. The tenant applies online
To request the Visale guarantee, the future tenant must create his personal space on the site Visale.fr:

The tenant must provide several supporting documents. The self-employed tenant must also provide specific documents.
2. Action Logement grants its visa
Action Logement checks whether the tenant complies with the conditions to obtain the Visale guarantee.
If so, Action Logement sends him a endorsement in a few working days.
The endorsement is used to prove to the owner (lessor) that the future tenant is eligible for the Visale guarantee.
3. The tenant gives the visa to the landlord (landlord)
The tenant can download and print the endorsement from its online personal account.
The tenant must hand it over to its future owner (landlord).
4. The owner (lessor) shall apply for the guarantee
The owner (landlord) must first create his personal space on the site Visale.fr :
Owner: access his personal space on Visale.fr
It then indicates the number of the endorsement, the name of the tenant and the characteristics of the accommodation.
A proposal for a guarantee is automatically created. The owner must validate it.
5. Signature of the lease
Once this has been done, the tenant and the landlord (lessor) can sign the lease, benefiting from the guarantee of Action Logement.
The unpaid amounts covered depend on the accommodation being rented:

The owner (lessor) must follow these steps:
1. From the 1st unpaid
Within 15 days of the unpaid, the landlord (landlord) must claim the rent from the tenant, by means of a notice to pay sent by registered letter with acknowledgement of receipt.
As soon as the unpaid amount exceeds the total of one month's rent and expenses (net of housing assistance), the owner (lessor) may report the unpaid amount to Action Logement from his personal online space.
Example :
For €450 monthly rent and €50 monthly charges,
- When the tenant does not receive housing assistance, it is possible to declare the unpaid amount as soon as it exceeds €450 + €50 = €500
- Where the tenant receives housing assistance from €120, it is possible to declare the unpaid amount as soon as it exceeds €450 + €50 - €120 = 380. €
After the owner (lessor) declares the unpaid amountand supporting supporting documents, Action Logement issues a subrogative receipt, which the owner (lessor) must validate online.
As soon as it is validated, receipt subrogative enables Action Logement to:
- To pay to the owner (lessor), within 5 working days, the amount of such receipt
- To recover from the tenant the amount of this receipt.
As long as the tenant has not paid all of his debt at Action Logement, the owner (lessor) must, from his personal online space, update monthly on tenant account, including where the tenant has resumed payment of the rent.

2. Where the tenant does not resume payment of the rent
Every month, the owner (lessor) must update, from personal online space, on tenant account and declare the new unpaid amount, as well as any amounts paid to him by the tenant.
This allows Action Logement to implement the recovery procedure and to cover the costs of this procedure. The recovery procedure may include termination of the lease and eviction of the tenant, if necessary.

The owner (lessor) is informed of the main steps of this procedure from his personal online space.
After recovering the accommodation, the owner (lessor) must
- Report to Action Logement the departure of the tenant
- And provide to Action Logement within 60 days, the balance of any account he has given to the tenant.

Action Logement offers a summary document time limits to be met by the owner (lessor).
After recovering the dwelling, the landlord (landlord) 60 days to ask Action Logement to take charge of the rental damage.
For this, from its personal online space, it must provide all supporting documents for degradation (inventory) and repair (invoice).
Action Logement issues a receipt subrogative, which the owner (lessor) must validate online.
As soon as it is validated, subrogative receipt enables Action Logement to:
- To pay to the owner (lessor), within 5 working days, the amount of such receipt
- To recover from the tenant the amount of this receipt.
Action Logement, after having paid the amounts due to the owner (lessor) within the limit of the amount taken over, recovers these amounts from the tenant.
The tenant repays Action Housing according to a timetable, which may be adjusted to take account of its financial situation. The tenant can apply for it within 2 months of the refund request, from his personal online space.
The tenant must pay his refunds from his personal online space.
Warning
When the tenant not on schedule of its refunds, Action Logement may apply to the judge for the termination the lease (i.e. the end of the lease).
