Is the sale of animals on the spur of the moment allowed?

No, no, no. In general, street hawking, i.e. the display in public places of goods for sale without regular authorization, is prohibited.

It is forbidden to sell any products, without authorization, on the pavement, roads, markets, etc. Thus, the sale of animals on the streets (puppies, kittens, rabbits, etc.) is forbidden.

Selling on the spur of the moment can be punishable by 6 months' imprisonment and €3,750 of fine.

However, the person making the sale on the spur of the moment may escape prosecution if he fulfills the following conditions:

  • He is a non-recidivist adult
  • And he pays a fine

The amount of the fine is €300 if it is paid within 45 days of the finding of the infringement or of the date on which the notice of infringement was sent.

This amount shall be increased to €600 if the fine is not paid within that 45-day period.

This amount shall be reduced to €250 if the person who sold the goods on the spur of the moment pays the fine directly to the police officer at the time of the finding of the offense or within 15 days after the finding of the offense or the date of the sending of the notice of offense.

In addition, the animal may be confiscated and handed over to an animal protection association.
