Do you need a city planning permit to divide land?

If you plan to divide your land into several parcels, an Advance Declaration (AD) or Planning Permit (PA) may be required depending on the situation of your land (protected site or not) or the improvements you plan to make.

To find out if your land is located in a protected site, you must ask your local council.

You must file a advance notification (PNR) if you do any of the following

  • Division of land to detach one or more lots from it for construction outside a classified site or pending filing, of a remarkable heritage site or to historic monument approaches
  • Division of land to detach one or more lots from it for the purpose of constructing without creating or fitting out of tracks, spaces or equipment common to several lots and specific to the subdivision

You can create your file by paperless means or using a form depending on whether you are in Paris or in another municipality.

You are not subject to RFP in the following cases:

  • Division authorized under an authorized development operation
  • Division in the framework of a rural land development operation
  • Division resulting from a rural lease consent to a farmer

You must file a advance notification (PNR) if you divide a land located in a particular protection area, because of the quality of the sites, natural environments and landscapes, delimited by a municipal council deliberation.
