How is a permanent official reclassified in the event of physical incapacity?

You are temporarily or permanently unfit due to an alteration in your state of health and you wonder how your reassignment to a new job compatible with your state of health takes place in this case? We present the reclassification scheme according to your public service of origin (State - FPE, territorial - FPT, hospital - FPH).

If you are temporarily or permanently unfit to perform your duties because of an impairment of your health, your workstation can be adapted to your abilities, where possible.

If this is not possible due to the needs of the service, your employer administration may assign you to a other use of your grade consistent with your medical condition.

This assignment to another job in your rank may occur after obtaining the opinion of the occupational doctor or the medical council.

The opinion of the medical council is required in the following cases:

If your medical condition does not allow you to perform the duties corresponding to the jobs of your rank, a reclassification device in another body of the State or in a territorial employment setting or a hospital body compatible with your state of health is implemented.

As part of this reclassification scheme, your administration offers you, after consulting the medical council, a period of preparation for reclassification.

If you refuse to take advantage of the period of preparation for reclassification, you are invited to apply for reclassification.

If you do not apply for reclassification, your employer administration may decide to offer you jobs accessible by secondment.

The period of preparation for reclassification is one period of occupational transition.

It is intended to prepare you and, possibly, to qualify you to perform new functions compatible with your state of health, if necessary outside your administration of assignment.

The period of preparation for reclassification may include periods of training, observation and situational training on one or more posts.

The period of preparation for reclassification shall take place in your home administration or any other State, territorial or hospital administration or public establishment.

When training, observation and situational periods take place outside your assignment administration, your hosting conditions are defined by an agreement between your assignment authority, host administration or institution and you.

The maximum duration of the preparation period on reclassification shall be one year.

Preparation of a project to prepare for reclassification

Your Employer Authority establish a project with you which defines:

  • The contents of the preparation for reclassification
  • The conditions for its implementation
  • The length of the readiness period at the end of which you will submit your application for reclassification.

Your employer administration also engages with you a job search in another body or framework of employment.

During the preparation period of the draft preparation for reclassification, you can already benefit from training, observation and situational periods on one or more positions.

Validation of the preparation for reclassification project

Your administration sends you the project of preparation for reclassification not later than 2 months after the start of the preparation period to reclassify in order to get your agreement and your commitment to respect it.

If you do not agree within 15 days depending on the date of its receipt, you are considered to be refusing the period of preparation for reclassification for the remainder of the period. You must then apply for reclassification.

Modification of the project to prepare for reclassification

The implementation of the project to prepare for reclassification shall be subject, at a frequency fixed when the project is drawn up, to a regular evaluation, by you and your employer administration.

During this evaluation, the content and duration of the project may be modified, with your agreement, so as to adapt them to your needs.

The draft may also be amended to take account of the opinion of the medical council when it is given during the period.

The project can be shortened in case of non-compliance with your commitments or when you are reclassified in a job offered by the administration.

Beginning of the period of preparation for reclassification

The period of preparation for reclassification shall begin from receipt of the opinion of the medical council by your employer administration.

You can ask it to start from the date on which your administration requests the opinion of the medical council. In this case, if the medical board finally issues an aptitude opinion, your employer administration may end the period of preparation for reclassification.

The start date of the period of preparation for reclassification may be postponed for up to 2 months if you and your employer's administration agree. During this deferral period, you are kept in an active position.

If you are on one of the holidays at the time of referral to the medical board or upon receipt of the medical board's opinion, the preparation period for reclassification shall commence from the date of your return to office:

  • Sick, long-term sick leave (LWD) or long-term sick leave (LWD)
  • Leave for temporary invalidity attributable to service (Citis)
  • Maternity or adoption leave
  • 3-day birth or adoption leave
  • Paternity and childcare leave.

End of reclassification preparation period

The period of preparation for reclassification shall end on date of your reclassification and no later than 1 year after the date on which it started.

If you are on one of the holidays during the period of preparation for reclassification, the end date of your period of preparation for reclassification shall be extended by the duration of this leave:

  • Sick, long-term sick leave (LWD) or long-term sick leave (LWD)
  • Leave for temporary invalidity attributable to service (Citis)
  • Maternity or adoption leave
  • 3-day birth or adoption leave
  • Paternity and childcare leave.

During the period of preparation for reclassification, you are in activity position in your original body and continue to collect your compensation usual.

The period of preparation for reclassification shall be treated as a period of actual service. It has no effect on your leave and promotion rights.

At the end of the period of preparation for reclassification, you shall be kept in an active position until the date of your reclassification, and for a maximum of 3 months.

Your employer administration must offer you several jobs accessible by secondment.

If your employer administration is unable to offer you such jobs, it must provide you with written reasons for this impossibility.

You have refused the period of preparation for reclassification

If you have refused the benefit of the period of preparation for reclassification, you must apply to your employer authority for reclassification.

You are not applying for reclassification

If you do not apply for reclassification, your employer's administration may, after receiving you for an interview, decide to offer you jobs that can be filled by secondment if you meet the following conditions:

  • You are permanently unfit to perform duties commensurate with your rank
  • You are not on sick leave, long-term sick leave (LSW) or long-term sick leave (LSW) or on leave for temporary disability attributable to service (Citis).

In this case, you can make a ex gratia appeal against this decision. Your employer's administration decides on your appeal after the HEADINGHEADING : Joint Administrative Commission.

Staging Modes

The reclassification takes place in an employment of another body or framework of employment priority in your home administration.

If this is not possible, you will be reclassified to any other public administration or institution of the State, territorial or hospital civil service if you have been declared fit to perform the duties corresponding to the proposed job.

Reclassification can be done by moving your home body to another rank.

You can also be reclassified by posting to a body or to a post of equivalent or lower level. At the end of a period of one year, you can ask for your integration into this body or framework of host jobs.

When you are detached due to a temporary incapacityAt the end of each period of secondment, your situation shall be reviewed by the medical council, which shall decide on your suitability to resume your initial duties. If you are still temporarily unfit, the medical council offers you to remain on secondment.

If the medical council finds that you have become permanently unfit to resume your initial duties, you can ask for your integration into your host body or employment after a year of secondment.

You can be reclassified to higher, equivalent or lower level posts or bodies under the conditions laid down by the special status of the body or framework of employment concerned pursuant to the provisions on:

  • At the internal promotion without taking into account any age limits if you are reclassified in the State civil service
  • To competition and recruitment without competition if you are reclassified to the territorial or hospital civil service.

The medical council may propose derogations from the normal rules for the conduct of competitions, examinations or recruitment procedures to adapt the duration and the splitting of tests to your physical abilities.

Services performed in your home body are treated as services performed in your host body or job setting.

When you are classified in a secondment or integration job at a step with a lower gross score than you held in your original grade, you retain the benefit of your previous gross score until you reach a gross score at least equal in your new corps or job framework.

FPT

If you are temporarily or permanently unfit to perform your duties because of an impairment of your health, your workstation can be adapted to your abilities, where possible.

Validation of the preparation for reclassification project

Your administration sends you the project of preparation for reclassification not later than 2 months after the start of the period of preparation for reclassification to obtain your agreement and commitment to comply with it.

The project can be shortened if you fail to meet your commitments or if you are reclassified to a job offered by your administration.

  • Leave for temporary invalidity attributable to service (Citis)
  • Maternity or adoption leave
  • 3-day birth or adoption leave
  • Paternity and childcare leave.

During the period of preparation for reclassification, you are in activity position in your original jobs and continue to collect your compensation usual.

The period of preparation for reclassification shall be treated as a period of actual service. It has no effect on your leave and promotion rights.
