What is the pension entitlement of a contractor who has become a civil servant?

Verified 01 September 2023 - Directorate for Legal and Administrative Information (Prime Minister)

If you were recruited as contractual in the public service before becoming a public servant, your pension entitlements may vary according to the date of your tenure and depending on whether or not you have requested the validation of your contract services with the pension fund that you depend on as a public servant.

Reminder

A public servant shall contribute to the SRE: titleContent, if he is a State official, or CNRACL: titleContent, if he is a territorial or hospital official (basic pension), and, since 2005, at the RAFP: titleContent (supplementary pension).

A contractor contributes to the Social Security Pension Insurance (basic pension) and theIrcantec: titleContent (supplementary pension).

Until 2010, you had to justifyat least 15 years services as a civil servant in order to be entitled to a civil servant's pension.

Since 2011, it is now necessary to justifyat least 2 years services as a civil servant in order to be entitled to a civil servant's pension.

If you have requested validation of your contract services, your Social Security Pension Insurance and Ircantec pension contributions have been refunded to the SRE or NACL according to your public service of origin.

These periods of work as a contractor are thus taken into account by the SRE or the NACL as if you had completed them as a public servant.

You got tenure before 2015

If you were a contractor before you were a public servant, you could ask, until 2014, that your contract services be validated for retirement as civil servant services.

Such a request is no longer possible since 2015.

If you have validated your contract services with the SRE or NACL, you will receive a pension from the SRE or NACL and a pension from the RAFP.

If your contract services have not been validated, you will receive the following 4 retirement pensions:

  • A SRE or NACL pension and a PFRA pension for your years as a public servant
  • And a Social Security Pension Insurance pension and an Ircantec pension for your contractual years

You have been appointed since 2015

If you were a member of a contract before becoming a public servant, you will receive the following 4 pensions upon retirement:
