Creation of a partnership foundation (Form)
Form to be sent by the institution at the initiative of the foundation or, by one of them (if several institutions are at the initiative of the foundation), to the rector of the academy in which the foundation will have its seat.
This form allows the publication of a notice of the foundation's creation in the JOAFEJOAFE : Official Journal of company associations and foundations must be completed and signed by the delegate.
The application file for authorization to create the foundation sent to the rector must mention:
- the name of the foundation, its seat, purpose and duration,
- the names, forenames, professions, domicile and nationality of the representatives of the founder or founders who are to sit on the board of directors,
- the names, registered offices and activities of the founder(s).
The dossier shall contain:
- the draft statutes of the foundation,
- the commitment of the founder(s) to contribute to the multiannual action program,
- the bank guarantee agreement guaranteeing this commitment.
Upon receipt of the application, the Rector of the Academy shall immediately issue a receipt for the application.
After instruction, the rector of the academy prepares the authorization decree and sends the file to the ministry responsible for higher education, which ensures the publication of the decree in the JOAFE.
The partnership foundation shall have legal personality from the day following publication in the OJTF.
